Re: Public health priorities for Bill 208 and related youth nicotine prevention measures

This memo sets out the public health priorities our network would like MLAs to consider as Bill 208 moves through the legislative process. It is intended as an informational submission and does not represent the views of any government body.

Our positions in brief

  • We support Bill 208 as a measured public health step.
  • We urge MLAs to keep the youth protection provisions intact through committee review.
  • We ask that enforcement resources match the scope of the new rules.
  • We ask for a published review of retail compliance and youth use trends within the first three years.

1. Keep the youth protection provisions intact

The bill's restrictions on youth-attractive flavours, on retail and online access points, and on display and promotion are the parts of the bill most directly supported by the public health literature. The Canadian Paediatric Society and Health Canada's youth prevention guidance have made the case for each of them.

2. Make sure enforcement matches the scope

Rules without enforcement do not reduce youth access in practice. Alberta's existing enforcement framework for smoking and vaping is a good base, and the bill should be accompanied by resourcing decisions that allow it to extend to the new rules.

3. Build in regular reporting

A short, public report after three years would let MLAs and the public see whether the bill is producing its intended effects. Reports could cover retail compliance, prosecutions where applicable, and trends in youth nicotine use drawn from existing surveillance programs.

4. Distinguish youth prevention from adult cessation

We are not asking for prohibition of nicotine products for adult consumers, and we recognize cessation support as a separate pillar of Alberta's strategy. Bill 208 is, in our reading, a youth prevention measure, and it should be evaluated as such.
